These Terms of Service ("Terms") are an agreement between you and Tomo Haus LLC ("Tomo Haus," "we," "us," or "our") governing your use of the TRKD+ mobile app and website (together, the "Service"). Please read them carefully. They include, in Section 12, an agreement to resolve disputes by binding individual arbitration and a waiver of class actions, which affect your legal rights. By creating an account or using TRKD+, you agree to these Terms. If you do not agree, do not use the Service.
1. Important: TRKD+ is not medical advice
Please read this section carefully.
TRKD+ is an informational tracking and organization tool. It is not a medical device, and it does not provide medical, clinical, pharmacological, or professional health advice.
- Nothing in TRKD+ is a recommendation, prescription, endorsement, or instruction to take, use, dose, combine, or discontinue any compound, peptide, supplement, vitamin, medication, or other substance.
- All content in the Service, including any educational material, half-life information, "estimated levels," charts, phase labels, injection-site diagrams, and reference notes, is provided for general informational and organizational purposes only, and is observational in nature.
- Any "estimated levels" or similar figures are rough, model-based estimates generated from the information you enter. They are not measurements of what is actually in your body, they are not a dosing guide, and they should never be relied upon to make health or dosing decisions.
- TRKD+ does not recommend dosages, timing, schedules, or protocols, and does not tell you what is safe or effective for you.
You are solely responsible for your own health decisions. Always consult a qualified, licensed healthcare professional before starting, stopping, or changing anything related to your health, and before acting on any information you organize or view in TRKD+. Never disregard professional medical advice or delay seeking it because of something you saw in the Service. If you may have a medical emergency, call your doctor or your local emergency number immediately.
You acknowledge that you use TRKD+ to track your own choices, made independently and at your own risk.
2. Eligibility
You must be at least 18 years old to use TRKD+. By using the Service, you represent that you are 18 or older and that you have the legal capacity to agree to these Terms.
3. Your account
To use most features, you create an account using Sign in with Apple, Google, or an email and password. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity under your account. Notify us at support@trkdplus.com if you believe your account has been compromised.
4. Your content and data
You own the information you enter into TRKD+. You grant us a limited license to store, process, and display that information solely to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for the accuracy of what you enter, and for keeping your own records if that matters to you. You can edit or delete your data, and delete your account, from within the app.
5. Acceptable use
You agree to use TRKD+ only for lawful purposes and only for your own personal tracking. You agree not to:
- Use the Service in any way that violates applicable law or regulation;
- Attempt to access, disrupt, reverse engineer, or interfere with the Service, its security, or its infrastructure;
- Use the Service to harm yourself or others, or to encourage others to do so;
- Misrepresent your identity or use another person's account without permission;
- Scrape, copy, or exploit the Service or its content except as expressly permitted.
We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to the Service or other users.
6. Intellectual property
The Service, including its software, design, text, graphics, and other content, is owned by Tomo Haus or its licensors and is protected by intellectual property laws. The medical illustrations in the Service are created by a board-certified medical illustrator and are used under license; they remain the property of their creator (Studio Hromi LLC). "TRKD+" and related names and logos are marks of Tomo Haus. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own personal, non-commercial tracking. You may not copy, distribute, modify, or create derivative works from the Service or its content except as expressly allowed.
7. Third-party services
TRKD+ relies on third-party services, including Apple, Google, and Apple Health, and integrates with them at your option. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and connecting or using them is at your discretion.
8. Apple App Store terms
The following applies when you download or use TRKD+ from the Apple App Store. These provisions are required by Apple and, to the extent your use is through the App Store, form part of the license between you and Tomo Haus:
- These Terms are between you and Tomo Haus only, not Apple. Apple Inc. ("Apple") is not a party to these Terms and is not responsible for TRKD+ or its content.
- License scope. Your license to use TRKD+ is a limited, non-transferable license to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that TRKD+ may be accessed by other accounts associated with you through Family Sharing where enabled.
- Maintenance and support. Tomo Haus, not Apple, is solely responsible for providing any maintenance and support for TRKD+. Apple has no obligation to furnish any maintenance or support.
- Warranty. Tomo Haus is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If TRKD+ fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to TRKD+.
- Product claims. Tomo Haus, not Apple, is responsible for addressing any claims by you or a third party relating to TRKD+ or your use of it, including product liability claims, claims that TRKD+ fails to conform to a legal or regulatory requirement, and consumer protection or similar claims.
- Intellectual property claims. In the event of a third-party claim that TRKD+ or your use of it infringes that third party's intellectual property rights, Tomo Haus, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information in the Service, including estimates, calculations, educational content, or data read from Apple Health, is accurate, complete, or current. You use the Service and rely on its information at your own risk. This Section applies in addition to, and does not limit, Section 1.
10. Limitation of liability
To the maximum extent permitted by law, Tomo Haus and its owners, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Service, or reliance on any content within it, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred U.S. dollars (USD 100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Tomo Haus and its owners, employees, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your violation of these Terms, or your violation of any law or the rights of any third party.
12. Dispute resolution, binding arbitration, and class action waiver
Please read this section carefully. It affects your legal rights and requires most disputes to be resolved through individual arbitration rather than in court.
Informal resolution first. Before starting an arbitration, you agree to first contact us at support@trkdplus.com and give us thirty (30) days to resolve the dispute informally. Most concerns can be resolved this way.
Agreement to arbitrate. If we cannot resolve a dispute informally, you and Tomo Haus agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration, and not in court, except as stated below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration may take place in the county where you live or by telephone or video, and the arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.
Exceptions. Either party may (1) bring an individual claim in small claims court if it qualifies, and (2) seek injunctive or other equitable relief in court to stop unauthorized use, infringement, or misuse of the Service or intellectual property.
Class action waiver. You and Tomo Haus agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.
Opt-out. You may opt out of this Section 12 by emailing support@trkdplus.com within thirty (30) days of first accepting these Terms, stating your name and that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.
Severability. If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, while the rest of this Section continues to apply. If any other part of this Section is found unenforceable, the remainder will still apply.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination, including Sections 1, 6, 8, 9, 10, 11, 12, and 14, will survive.
14. Governing law
Except for the arbitration agreement in Section 12, which is governed by the Federal Arbitration Act, these Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration and proceeds in court, you agree that it will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
15. Changes to these Terms or the Service
We may update these Terms or change or discontinue parts of the Service from time to time. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of TRKD+ after an update means you accept the revised Terms.
